New plant protection product classification: What has changed as from November 26, 2015

With the entry into force of the NAP (National Action Plan to achieve the sustainable use of pesticides), a new classification of Pesticides, which involves classifying them according to their specific use, was adopted.

The NAP (National Action Plan for the sustainable use of pesticides), was implemented on January 22, 2014 and it upgraded both the system then used in Italy based on European standards and the EC Directive 2009/128 and established a framework to achieve a sustainable use of pesticides.

The aim of the plan was and is to:

  • promote organic farming;
  • limit the use of pesticides;
  • defend consumers’ health and protect end users;
  • safeguard the environment and water biodiversity often undermined by the excessive use of pesticides.

Professional and non professional use of Pesticide

Pesticides are now divided into two main categories:

  1. those intended for non-professional users;
  2. those intended for professional users.

Non-professional users need not be licensed in order to purchase pesticides while professional users will need to be trained and possess a license or certification.

Pesticides intended for non-professional use (not requiring a license) are those used for the protection of edible and ornamental plants. These pesticides do not contain substances considered to be carcinogenic, mutagenic, toxic for embryonic development and reproduction or classified as toxic, very toxic, corrosive or sensitizing. Pesticides not intended for professional use are further classified as:

  • Irritants Xi;
  • Unclassified.

It is required that these products have labels affixed with recommendations on the safe handling of the products. However, in spite of the non-dangerousness of the products, they may be sold only to people over age and they must have specific use and safety instructions affixed to the containers.

In order to safeguard biodiversity,  no chemical substances which could alter the endocrine system, which have a toxic effect on the nervous and/or immune systems or which may be lethal for bees may be sold without the proper license or certification.

Pesticides for professional use are classified as:

  • Very Toxic T +;
  • Toxic T;
  • Harmful Xn.

These are products that can be used only following specific instructions and wearing suitable devices to protect the health of workers who utilize regularly inspected pesticide application equipment.

This new EU Directive further establishes that those who exercise advisory activities on the use of pesticides also need to have proper authorization.
